Terms of reference
Chengdu Sit New Energy Technology Co., Ltd is a wholly-owned subsidiary of Sineng Electric Co., Ltd. The EnjoySolar APP related products are distributed photovoltaic power station services provided by Chengdu Sit New Energy Technology Co., Ltd.
Sineng Electric and Chengdu Sit New Energy have always attached importance to the protection of personal information security and privacy in data services. We hope that through this privacy agreement to let you understand the way we handle personal data. It is therefore recommended that you read this privacy agreement in its entirety to help you understand how to protect your privacy and make your choices after reading it. If you choose to accept this privacy agreement, you can use our products and services. If you cannot accept, please stop using our products and services.
This privacy agreement is limited to the products and services provided by EnjoySolar software platform or web-based, mobile-based APP under Chengdu Sit New Energy Technology Co., Ltd. and Sineng Electric Co., Ltd. . including but not limited to:
(1)The EnjoySolar APP
(2)The EnjoySolar Web
You can use the above features of our APP or Web to enjoy various services, for example: to know the basic information of your new plant, to know the abnormal alarm information of the plant and contact us at any time to provide you with plant data services and so on.
In this agreement, "Sineng Electric Co., Ltd." and "Chengdu Sit New Energy Technology Co., Ltd. " are called "We" and "Data subject" is called "You".
1.1 How we collect your information
(1)when you register your account with our EnjoySolar platform, creating your personal identification information, telephone number, email account, name of power station, location of power station and so on.
(2) after the power station is successfully created, the basic data information of the inverter and other device of the power station you built collected through our collector and sent to our cloud service system.
(3)after compiling the basic data of your power station through our big data system, the final real-time and historical data built on our EnjoySolar platform such as power generation, power consumption and power grid.
Therefore, the scope of information we use is all your personal information we collected above.
1.2 How we use and store your information
By registering your account and creating a power station on our EnjoySolar platform, we can get your personal and basic information about the power station.
How we use your personal information to serve you, including but not limited to:
(1)you can use the email or mobile phone number you submitted when registering to log on the EnjoySolar platform;
(2)by using the geographic location, time zone, installed capacity and other information submitted when you created the power station, we can determine the specific physical information of your power station, combined with weather, radiation and other data, we will calculate the statistical and analytical data of the power station reasonably and accurately for you such as the power station yesterday PR value, equivalent to save standard coal quantity and other data information.
In order to use your information to serve you, we will store your personal information for a period of time. We store your personal information in a database. The time of storage depends on the nature of the information and the purpose of the service. If you have any special storage requirements, please let us know. The normal storage period is no more than 25 years.
2.1 Information sharing
To provide you with location-based related functions/services, the EnjoySolar platform integrated with the Autonavi mapping SDK. When providing you with location functions/services, the Autonavi SDK needs to collect and use your device information, location information, WLAN and other sensor information, you can also opt-out via https://lbs.amap.com/agreement/user_device. Network information |
We may share your information with suppliers and installers of plant device in order to ensure the smooth operation of the plant you are creating and the removal of obstacles in order to provide you with continuous product and data services. We will sign a confidentiality agreement with the above device suppliers and installers, requiring them to assume the same obligations as we do in this privacy policy.
We guarantee that we will not share your information with any third party other than the above device suppliers and installers except for the following reasons:
(1) to obtain your prior written consent and authorization;
(2)in accordance with the requirements of relevant executive branch and judiciary and the provisions of laws and regulations;
(3)the system will automatically view your plant application initiated by the device supplier and distributor, because if you do not share the information, we will not be able to continue to provide you with normal data services or meet your requirements.
Our product is based on DCloud uni-App (5 + App/WAP2APP) , which collects your device unique identifier (IMEI/Android ID/DEVICE_ID/IDFA, SIM card IMSI information, OAID) to provide statistical analysis services, and through the application of startup data and abnormal error log analysis to improve performance and user experience, to provide better services for users. The uni-app framework will apply for the mobile security alliance OAID, also known as the mobile intelligent terminal supplementary device identification system. The mobile intelligent terminal supplementary equipment identification system and SDK strictly comply with the requirements of relevant laws and regulations such as China's Network Security Law, Data Security Law, Regulations on the Protection of Personal Information of Telecom and Internet Users, and national standards such as the Information Security Technology Personal Information Security Specification. The SDK will not actively collect any data. It only obtains the following data when the APP is called, which is used for local judgment, and will not carry out any network transmission: device manufacturer, device model, and device brand. It is used to judge the name of the network operator of the terminal call interface device, to judge the virtual machine environment APP package name, and to verify the signature.
2.2 Information transfer
We promise not to transfer your information to any third party except for the following reasons:
(1) to obtain your prior written consent and authorization;
(2) in accordance with the requirements of relevant executive branch and judiciary and the provisions of laws and regulations;
(3) if we are unable to continue our services due to force majeure, bankruptcy or liquidation, we will inform you in advance and obtain your consent, transfer all of your data and information on our SOLAR platform so that you can continue to receive services from other third parties, who are also subject to privacy agreements.
2.3 Information disclosure
We promise not to transfer your information to any third party except for the following reasons:
(1) to obtain your prior written consent and authorization;
(2) in accordance with the requirements of relevant executive branch and judiciary and the provisions of laws and regulations;
(3) in an emergency, if you do not disclose your personal information, you will not be able to avoid and reduce the possible losses or protect your legitimate rights and interests.
3.1 The data protection measures
We use reasonable technical measures to protect the information collected about your personal data. We also take a number of technical measures to prevent security vulnerabilities and unauthorized access to personal data. Because of the nature of the Internet, we cannot guarantee the absolute security of your information, despite our best efforts, Therefore, you understand this risk and fully comprehend it.
The main data protection measures we have adopted include:
(1) check the system and application on a regular basis, and repair the system in time after discovering the loopholes, so as to avoid the loopholes being exploited by hackers and resulting in data leakage;
(2) closely monitor the core data, real-time monitor your personal core data in the system, review and audit sensitive operational activities on a regular basis. In case of any data risk operation, find and deal with it in time;
(3) desensitization of sensitive data, as follows: the application system is divided into internal and external, desensitize the external system to prevent network attacks, desensitize the internal system and operate hierarchical data management to prevent internal leakage of information.
3.2 Emergency processing and notification
In the event of any information leakage and other security risks, we will immediately start the data protection contingency plan, and try to reduce unnecessary data risks and losses. Our emergency response measures include:
(1) first of all, the service fuse mechanism. When there is a data security risk in the system, we will start the service fuse mechanism in time, that is, according to the data security risk level, we will restrict access/stop access/stop maintenance to the service and so on. Protect your data from further data leakage;
(2) second, the data recovery mechanism. The system will perform a multidimensional data backup of your data, counter the broken data restoring, and guarantee the data is available.
In the event of a personal data breach, we will notify the data regulator without undue delay, as far as practicable, within 72 hours of the discovery of the data breach, unless the disclosure of such data poses no risk to the rights and freedoms of individuals. If we do not notify the regulator within 72 hours, we will explain.
We will notify you without undue delay of the disclosure of your personal data and the emergency measures we have taken, when the disclosure of your personal data is likely to endanger your rights and freedoms.
If you find any suspected leakage of your personal information, please contact us immediately through the contact information notified in this agreement so that we can verify and take action accordingly.
4.1 Access your personal information
You can log on and access your personal information at any time after you create a power station through our registered account on the EnjoySolar platform. You can also contact us at any time to explain and verify your data. This information includes but is not limited to the basic information when you register your account to create the power station, as well as your power generation duration, power generation capacity and any other information displayed on our platform.
4.2 Change and update your personal information
When you find any possible omission or error in your personal information, you can log in to the platform to change and update; When you find that you cannot change or update by yourself, you can contact us at any time for data change and update. If we find that there is indeed information omission or error after confirmation, we will change and update immediately.
4.3 Delete your personal information
(1) when you decide not to use the services of our EnjoySolar platform, you can cancel your account and delete the station information yourself. Your personal information will be deleted by default at the end of the 7-day confirmation cycle, or you can contact the customer service staff to request immediate deletion. Please make a backup of your personal information before you cancel your account to avoid unnecessary loss.
(2) you may ask us to remove certain personal data we have collected from you if you believe that it is not necessary for the purpose of collecting or otherwise processing the data. But you know, if the deletion of this information will affect the subsequent normal maintenance and processing of your power station data and information, we will not assume any responsibility.
(3) if you believe that your personal information has been improperly handled, you may immediately contact us for clarification and explanation, and if you deem it necessary, you may ask us to delete the information.
(4) to comply with our legal obligations under the laws of EU Member States, you may request us to delete your personal information if necessary.

4.4 Restrict the processing of your personal data
(1) if you have any objection to your personal data being displayed on our EnjoySolar platform, you may request us to verify your personal information within a certain period of time.
(2) if you think that our data processing is illegal, you may object to our data processing and request the use of that personal data be restricted. But please provide us with the reasons for your objection so that we can assess whether we have sufficient legal basis to continue processing these data.
(3) when we no longer need some of your personal information for certain processing purposes, you may request us to keep it if you feel you need to do so in order to establish, exercise and defend your rights.
4.5 Instructions for gaining access to the EnjoySolar APP
To provide you with your services and keep your account secure, EnjoySolar APP may need to ask you for access to the appropriate level of security. You may rest assured that the EnjoySolar APP does not have these permissions enabled by default, and is only possible to collect your information through these permissions if you actively confirm that you are enabled.
It should be noted that just because you have access to a specific privilege does not mean that it will necessarily collect information about you; even if you have confirmed that you have access to that privilege, the EnjoySolar APP will also only collect information about you as far as it is legal, legitimate and necessary. If you choose not to enable permissions, this may result in you not being able to use the specific features associated with this permission, but it does not affect your ability to use other services provided by the EnjoySolar APP.

When you contact us through our listed contact information, for security purposes, we first need to verify your identity. After verification, our staff will decide whether to proceed immediately or to postpone processing according to your request. The time limit for immediate processing is 1-3 working days. The time limit for extension processing is 15 working days in general. If you need to extend the processing time under special circumstances, we will inform you of the extended time after the assessment.
We reserve the right to refuse your request if:
(1) if your request is detrimental to national interests and social public interests;
(2) if there is sufficient evidence to prove that your request is based on malicious intent and abuse of rights;
(3) suspected of violating other people's privacy or other legitimate rights and interests;
(4) your request is beyond the scope of our services.
In order to provide you with the above service content or the corresponding service function upgrade, some personal data information you provide to us may be transferred between our branches and device service agencies. This may be different from where you are located, the information may be transferred to an overseas jurisdiction. The overseas transfer of such information is necessary for processing and managing your account and providing services to you. Please understand and agree to do so.
If you request the transfer of your personal information collected by us to a country or region other than China or the EU, you may be required to provide the relevant laws or regulations for data protection in that country or region, to ensure that the information is transferred across borders in accordance with local laws and regulations. If you insist that we move information across borders without proof that it is in compliance with local data laws and regulations, we have the right to refuse and to discontinue our services. If you provide inaccurate information and cause us to transfer your information across the border in violation of the relevant local data protection laws and regulations, you will bear the loss, and we have the right to lodge a claim against you for the loss thus caused to us.
This privacy agreement shall be governed by the laws of China without regard to its conflict of law provisions. The parties involved in this Agreement shall submit the dispute to the competent court in Wuxi, China for jurisdiction.
